Introduction

The booking system is provided by Chairsyde Video Consulting Limited of 1 Beauchamp Court, 10 Victors Way, Barnet, Hertfordshire, EN5 5TZ (we, us). All rights in the booking system belong to us, and you may use it only to book a video conference with a clinician.  We also host the video conference with your chosen clinician.

By using the booking system and video conference, you agree to be bound by these terms of use. These terms of use affect your legal rights and obligations so please read them carefully. If you do not agree to be bound by these terms of use, do not use our booking system or video conference.

We may update these terms of use from time to time at our discretion, so please check these terms of use each time you wish to book a video conference.

Use of our booking system

To use our booking system, you must be at least 18 years old and be legally capable of entering into a contract. You must provide all information required by your clinician within the booking system, including personal data. You agree that all information you provide will be accurate and complete. The information must relate to you, or if the information relates to a third party, you agree that you have the lawful right to provide such information to us. This maybe because the third party has given you permission or because the third party is your child or you otherwise have parental responsibility.

All information you provide to us, including any images shall be lawful and by providing that information to us, you must not infringe the rights of any other person.

We do not promise that the booking system will always be available. There may be occasions when access to the booking system may be interrupted, including for scheduled maintenance or upgrades, for emergency repairs, or due to failure of telecommunications links and/or equipment.

Payment

Your booking is not accepted until you have paid the fee in full. Payment is made through our third party payment provider, Stripe. Once payment has been received in full, you and your clinician have entered into a contract to provide and receive services through the video conference on the date and at the time set out in your booking.

On acceptance of your booking, we will send you an email to confirm the details of your video conference, with a link to access the video conference and with another link to cancel the booking if you need to do so. We shall send you an email with the links again, closer to the time of your video conference as a reminder.

Cancellation

You can cancel your booking and receive a full refund of the fee paid provided that you do so at least 24 hours before the start of your video conference. To cancel, please click the link in the email that we send you on acceptance of your booking and follow the prompts.

We rely on the clinician to keep their diary up-to-date, but for a variety of reasons the clinician might need to cancel or postpone your booking. If they do so, and you are unable to arrange an alternative time or date that suits you, then we shall refund you the fee paid.

Video conference

You should click the email link we have sent to you to access the video conference with your clinician. Please select a quiet and appropriate location for the video conference to take place.

We shall not be liable if you are unable to access the video conference for any reason within your control, including your failure to use appropriate equipment or insufficient bandwidth. If a technical fault occurs that prevents the clinician from accessing the video conference, we shall work with you and the clinician to rearrange the video conference to another time and date.

If you have made the video conference booking for a child under age 18, you agree that an adult will attend the video conference at all times too.

Disclaimer

We are not liable for the acts or omissions of the clinician whether during the video conference or otherwise. You should contact the clinician directly if you wish to discuss any aspect of their service. We do not recommend or endorse any particular clinician who uses our booking system. We are simply the platform that the clinician uses to manage their bookings, process payments and host the video conference.

We shall be liable only for direct losses that you suffer as a result of our breach of these terms of use or our negligent act or omission.

The copyright in all content on the booking system is owned by or licensed to us. All rights are reserved.

Personal data

We only collect the personal data that your clinician has asked us to collect.  The clinician is therefore the controller of your personal data at all times; we are simply the processor. We will share all your personal data with the clinician, and process your personal data only on their instructions.

We will of course comply with all of our obligations under the applicable data processing laws, but if you have any questions or comments about our processing of your personal data, you should speak to your clinician first. You can still exercise any of your legal rights under applicable data protection legislation. Some of these rights are complex, and not all of the details have been included below.   • Right of access: You have the right to obtain from us a copy of the personal data that we hold for you.
  • Right to rectification: You can require us to correct errors in the personal data that we process for you if it is inaccurate, incomplete or out of date.
  • Right to portability: You can request that we transfer your personal data to another service provider.
  • Right to restriction of processing: In certain circumstances, you have the right to require that we restrict the processing of your personal information.
  • Right to be forgotten: You also have the right at any time to require that we delete the personal data that we hold for you, where it is no longer necessary for us to hold it. However, whilst we respect your right to be forgotten, we may still retain your personal data in accordance with applicable laws.
  • Right to stop receiving marketing information: You can ask us to stop sending you information about our services (if you have asked us to send you such information), but please note we shall continue to contact you in relation to any matters relating to your booking.

You acknowledge that we shall notify your clinician if you exercise any of these rights.

We also confirm that we will only retain your data for as long as your clinician requests that we do so, and whilst we hold your personal data we shall process it in a manner that ensures appropriate security of the personal data, including protection against unauthorised or unlawful processing and against accidental loss, destruction or damage. General

These terms of use are governed by and will be construed in accordance with the laws of England and Wales. Nothing in these terms of use affects your statutory rights as a consumer.
